Attempt to Elude (Misdemeanor)
Hit and Run

Location: NW 12th Street near NW Oceanview Drive

Date/Time: May 31, 2007 @ 11:30 AM

Victim: Kathleen Macfarland, 12/27/1939, Newport Resident

Arrested: Andrew D. Hayner, 04/25/1985, Eugene, Oregon Resident

Details: On 05/31/2007 at about 11:30 AM Newport Officers were dispatched to a report of a Hit & Run. Officers were advised the suspect vehicle had left the scene of the crash south on NW Spring Street. Officer TJ Eriksen proceeded to the area in an attempt to locate the suspect vehicle, as he approached the intersection of NW 9th Street and NW Spring Street he passed the suspect vehicle. Officer Eriksen turned around to conduct a traffic stop and when doing so the suspect turned west onto NW 9th Street, traveling at a high rate of speed. Officer Eriksen activated his emergency lights and attempted to stop the vehicle. After a short pursuit Officer Eriksen caught up to the vehicle in the area of NW 11th Street and NW Coast Street. Officer Eriksen found the vehicle stopped in the road and unoccupied. Other police officers arrived in the area to assist with the search of the suspect. They were given the description of the driver and passengers from construction workers who were working nearby. After a short search one subject was located and determined to be the passenger. Later officers located Hayner who matched the description of the person driving the vehicle. He was taken into custody for questioning and later arrested and lodged in the Lincoln County Jail.

During his investigation Officer Eriksen learned that Macfarland was traveling north on NW Oceanview Drive just past NW 12th Street, when the vehicle Hayner was driving crossed over the center line and struck Macfarland's vehicle. Hayner was traveling south on NW Oceanview, and after hitting Macfarland's vehicle he continued south on NW Spring Street.

Hayner was charged with Hit & Run, Attempt to Elude (Felony), Attempt to Elude (Misdemeanor), and Initiating a False Report. His bail was listed at $50,000.00. The Newport Police Department was assisted by the Lincoln County Sheriffs Office, Oregon State Police, and the United States Coast Guard. No one was injured as a result of this incident.
