Incident:       Burg I/Assault IV/Resist Arrest Case: 07N-02727

Location:       800 blk of SW 10th St

Date/Time:      11-13-07 @ 7:59 hours

Suspect:        Hernandez, Joshua Stevan  DOB/032088

        Yankee, Cody M, Age 16

Details: On 111307, at about 7:59, a Newport resident from the 800 blk of SW 10th Street called to report that two subjects had just been at his residence and had threatened to kill him.  The victim was able to identify one of the suspects by name and told dispatchers that he had to force the suspects from his home.  A responding Newport Police Officer located both suspects in the Armory parking lot while responding to the call.  When the officer tried to question the suspects, Joshua Hernandez originally gave the officer a false name and date of birth.  Hernandez became resistive and fought with the officer, which prompted citizens in the area to call 911 and request help for the officer.  A second officer arrived and Yankee fought with him.  With the help of Lincoln County Sheriff’s deputies and other Newport Police officers, both were taken into custody.

After further investigation by Newport officers, Hernandez was lodged at the Lincoln County Jail on charges of Burglary I, Menacing, Disorderly Conduct, False Information to a Police Officer, Resisting Arrest, Delivery of an Imitation Substance, and Assault IV, with the bail set at $142.500.00. Once at the jail, several small baggies of a white powdery substance were located on Hernandez by corrections deputies.  When questioned, Hernandez told officers that the substance was cocaine, but later admitted he had been selling baking powder to different persons after telling them it was cocaine. 

Yankee was detained and lodged at the Lincoln County Juvenile Detention Center on charges of Burglary I, Menacing, Disorderly Conduct and Resisting Arrest.
