       Incident:     Pedestrian Enforcement Operation                                  

 

Details:         On Tuesday, May 27, 2008 from 11:00 a.m. to 4:00 p.m., the Newport Police Department will be conducting a “Targeted Pedestrian Enforcement” operation in the crosswalk at East Olive Street and NE Eads Street.  The five-hour operation focuses on drivers failing to yield to pedestrians in the crosswalk.

 

Citations will be issued for pedestrian violations in this operation. Citations are given in an effort to raise public awareness and education of pedestrian right of way laws.  Citations will also be issued for all other violations.

 

In intersections not controlled by electronic traffic control devices, Oregon law requires that a driver must stop and remain stopped if a pedestrian is walking in your lane of traffic or the adjacent lane.  If a pedestrian is crossing in a crosswalk at a traffic light, then you must stop if the pedestrian is within your lane or six feet in the adjacent lane.

Incident:             Assault II / Menacing                        Case: 08N-01782

 

Location:            Agate Beach State Park

 

Date/Time:            05/20/08 at 2:44 p.m.

 

Victim:                   Edgar Herrera Mata, age 23 of Newport                                                                                

 

Suspect:               Raymundo Rodriguez Rosete, age 27 of Newport

 

Details:                  On 05/20/08 at about 2:44 p.m., Newport Police officers were dispatched to the Agate Beach State Park on a report of a fight in progress.  Upon arrival, officers located two subjects, one of which was suffering from a possible broken forearm.  The fight was witnessed by several persons, who stated that Raymundo Rodriguez Rosete and Edgar Herrera Mata, both of Newport, had been physically fighting with each other.  During the fight, Rodrigquez Rosete obtained a tire iron and struck Herrera Mata at least once in the arms while he tried to fend off the attack.

 

Rodriguez Rosete was taken into custody and lodged at the Lincoln County Jail on charges of Assault II and Menacing, with the bail set at $57,500. 

 

Herrera Mata was treated at the scene by medical personnel from Pacific West Ambulance.  He refused to be transported to the hospital.

Incident:             Escape / Warrant Service                Case: 08N-01775

 

Location:            Nye Beach Turn-a-Round

 

Date/Time:            05/20/08 at 11:24 a.m.

 

Suspect:               Mark A. Simmons, 21 years old from Siletz

 

Details:                  On 05/20/08, a Toledo PD Detective was in the Nye Beach area when he observed Mark Simmons of Siletz, whom he knew had a warrant for his arrest.  The detective contacted Simmons, identified himself as a police officer and told Simmons he was under arrest.  Simmons ran from the Toledo PD detective, who called for assistance.  Newport Police officers and a Lincoln County Sheriff’s Office Detective responded to the area to assist.   Simmons was found hiding in the brush in the area of NW 12th and Spring Streets about 30 minutes after he initially escaped from the Toledo Detective.

 

Simmons was lodged at the Lincoln County Jail on the warrant, which charged Fail to Appear and a new charge of Escape III, with the bail set at $15,000.
