Details: On 2-26-08 Newport Officers and Detectives were at a residence on Coast Street, in Newport investigating a Felony Sex crime. While interviewing the suspect near the residence, Ms. Lehrman approached the officers and began screaming at them to leave. The officers tried to explain why they were at the location however Ms. Lehrman continued to scream at them, using obscenities and interfering with the investigation by remaining in the immediate area and screaming at the officers while she stood right beside them. The officers warned her that she could be arrested and tried to calm her down by giving her a few moments to regain control of herself. Ms. Lehrman’s extreme behavior made it impossible for the officers to continue their investigation so an officer took her arm to direct her out of the yard. Ms. Lehrman was told that she was under arrest and at which time she resisted by swinging at the officer and then began struggling violently to get away from him. With the help of another officer Ms. Lehrman was placed into handcuffs.
As the officers began to escort Ms. Lehrman out of the yard area Mr. Card and an as yet unidentified female arrived on scene. The unidentified woman initially approached the officers but stepped away after being told very forcefully by another officer not to interfere. Mr. Card stood in the gateway and would not move as the officers approached with Ms. Lehrman. An officer told him several times to move, however Mr. Card refused to move while demanding to know why Ms. Lehrman was being arrested. One of the officers who was trying to escort the still screaming and struggling Ms. Lehrman out of the yard was forced to push Mr. Card out of the way to exit.
Two officers took Ms. Lehrman to a patrol car that was parked nearby and prior to putting her inside the car began to check her for weapons or means of escape by conducting a “frisk” or her clothing. Ms. Lehrman pulled away from the officers and fell upon the ground, rolling to her back. When an officer approached her she began kicking him repeatedly in the chest and shoulders.
The officers were able to regain control of Ms. Lehrman and placed her in the patrol car. She was transported to, and lodged at the Lincoln County Jail.
Due to the volatility of the situation the officers did not make any attempts to take Mr. Card into custody for Interfering with a Peace Officer. On 2-27-08 officers located Mr. Card and took him into custody for Interfering with a Peace Officer. He was taken into custody without incident and lodged at the Lincoln County Jail.
